Requirements for Employers Seeking to Hire Non-U.S. Workers

Before hiring foreign nationals to fill open positions, employers must certify that they have actively sought out American workers for those positions (PERM labor certification). Employers must also demonstrate that the job market for U.S. workers will not be negatively affected by their hiring of foreign nationals.

Types of Employment-Based Visas for New International Hires

Permanent employment visas are categorized according to preference:

  • First preference, EB-1 — a visa reserved for employees with extraordinary ability in business, science, the arts, education, and other fields.
  • Second preference, EB-2 — a visa reserved for employees with specialized degrees in healthcare, architecture, engineering, and certain other fields. May include workers with applicable training and experience in specialized fields.
  • Third preference, EB-3 — a visa reserved for employees who have training or experience in areas where U.S. workers are in short supply.
  • Fourth preference, EB-4 — a visa reserved for "special immigrants," including religious workers, certain former employees of the U.S. government, translators and interpreters who meet certain criteria, and others.
  • Fifth preference, EB-5 — a visa reserved for foreign nationals who plan to start a business or enterprise in the U.S. The extension of this visa is based upon a review of that business after two years.
